HamstockThese Terms of Service (the “Terms”) govern your access to and use of the Hamstock mobile application (the “App”), the website at hamstock.app and any related services (together, the “Services”), operated by Uygar Acar (“Hamstock”, “we”, “us” or “our”).
By creating an account or using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.
Eligibility
You must be at least 13 years old, or the minimum age required in your country, to use the Services. If you are under the age of majority where you live, you may use the Services only with the consent of a parent or legal guardian.
Your account
You need an account to use the Services. You agree to provide accurate information, to keep your sign-in credentials secure, and to tell us promptly of any unauthorised use. You are responsible for all activity under your account. You may delete your account at any time in the App’s settings.
Licence to use the Services
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable and revocable licence to use the App on devices you own or control, for your personal, non-commercial use. All rights not expressly granted are reserved.
Subscriptions
Certain features, such as Hamstock Chef, are offered as auto-renewing subscriptions. Prices and billing periods are shown in the App before you purchase.
- Payment is charged to your app store account when you confirm the purchase.
- Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours before the end of the current period.
- You can manage or cancel subscriptions in your app store account settings. Deleting the App or your account does not cancel a subscription.
- Refunds are handled by the app store you purchased through, in accordance with its policies.
- We may change subscription prices. Where required, you will be notified in advance and may cancel before the change takes effect.
Virtual currency and items
The Services may include virtual currency and virtual items, some of which can be purchased (“Virtual Items”). Virtual Items are licensed, not sold, to you. They have no monetary value, cannot be redeemed for cash or exchanged for real-world goods, and cannot be transferred or sold. Except where required by law or by the applicable app store’s policies, all purchases are final and non-refundable. Virtual Items are tied to your account and are forfeited if your account is deleted or terminated. We may modify, discontinue or reprice Virtual Items at any time.
Generated content
Some features, such as recipe suggestions, use automated systems, including artificial intelligence, to generate content. Generated content may be inaccurate, incomplete or unsuitable for you. You are responsible for evaluating it, including checking ingredients for allergies and dietary requirements and following safe food handling practices.
No professional advice
The Services are provided for general informational and entertainment purposes. Dates, quantities, estimated savings, recipes and other information in the Services are estimates and are not medical, nutritional, dietary or food-safety advice. Always use your own judgement about whether food is safe to eat.
Your content
You retain ownership of the content you submit to the Services (“Your Content”). You grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, process, display and transmit Your Content as needed to operate, provide and improve the Services. Content you share with other users will be visible to them.
Acceptable use
You agree not to:
- use the Services for any unlawful purpose, or to harass, abuse, threaten or impersonate others;
- submit content that is unlawful, offensive or infringes the rights of others;
- copy, modify, reverse engineer, decompile or create derivative works of the Services, except as permitted by law;
- access the Services through automated means, interfere with their operation, or circumvent usage limits or security measures; or
- use the Services in any way that could damage our reputation or the experience of other users.
Intellectual property
The Services, including all software, designs, characters, artwork, text and trademarks, are owned by us or our licensors and are protected by intellectual property laws. Nothing in these Terms transfers any of those rights to you.
Feedback
If you send us ideas or suggestions, we may use them without restriction or compensation to you.
Third-party services
The Services may rely on or link to third-party services that we do not control. We are not responsible for third-party services, and your use of them may be subject to their own terms.
Suspension and termination
You may stop using the Services at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or if we discontinue the Services. Sections that by their nature should survive termination, including those on Virtual Items, generated content, intellectual property, disclaimers and limitation of liability, will survive.
Disclaimers
The Services are provided “as is” and “as available”, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Services will be uninterrupted, error-free or secure.
Limitation of liability
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or goodwill, or for food that spoils, is wasted or causes illness, arising out of or relating to your use of the Services. Our total liability for any claim relating to the Services will not exceed the amount you paid us in the twelve months before the claim arose.
Nothing in these Terms limits any liability that cannot be limited under applicable law, or any rights you have as a consumer that cannot be waived.
Indemnity
To the extent permitted by law, you agree to indemnify and hold us harmless from any claims, losses and expenses, including reasonable legal fees, arising out of your misuse of the Services or your breach of these Terms.
App store terms
If you downloaded the App from the Apple App Store, you acknowledge that these Terms are between you and us, not Apple Inc. (“Apple”). Apple is not responsible for the App or its content, has no obligation to provide maintenance or support, and is not responsible for addressing any claims relating to the App, including product liability claims, claims that the App fails to conform to legal or regulatory requirements, consumer protection claims or intellectual property infringement claims. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App; to the maximum extent permitted by law, Apple has no other warranty obligation. You must comply with applicable third-party terms when using the App. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. Your use of the App is also subject to Apple’s Licensed Application End User License Agreement, which applies to the extent it does not conflict with these Terms.
Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above and, where the changes are material, notify you through the Services. By continuing to use the Services after the changes take effect, you agree to the updated Terms.
General
If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce any provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a business transfer. These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Services.
